Welcome to Learn Drums Video Game. These Terms of Service ("Terms") govern your access to and use of the website www.learn-drums.app and the Learn Drums Video Game mobile, tablet, and web application (collectively, the "Service").
By creating an account, subscribing, or using the Service, you agree to be bound by these Terms. The Service is operated by Pietro Valente ("we," "us," or "our").
Learn Drums Video Game is an interactive, gamified music education application designed to help users learn and practice playing the drums using electronic or acoustic drum kits via USB/MIDI connections or real-time audio detection.
You must create an account to access paid features and track your progress. If you are under the age of 18 (or the legal age of majority in your jurisdiction), you may only use the Service with the involvement and consent of a parent or legal guardian.
We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service strictly for your personal, domestic, and non-commercial educational purposes.
Music Schools and Teachers: Commercial use, classroom instruction, or sharing a single account across multiple students is strictly prohibited without an explicit commercial/institutional license agreement. Please contact us directly at info@learn-drums.app to request commercial licensing terms.
You are responsible for maintaining the confidentiality of your account credentials. You agree not to:
Share, sell, or transfer your account or subscription to third parties.
Reverse engineer, decompile, disassemble, or extract source code, audio samples, drum scores, or graphical assets from the app.
Use automated tools (bots, scrapers) to bypass security or modify game mechanics.
Access to full game levels, songs, and exercises requires a paid recurring subscription (monthly or annual). Subscriptions purchased via our website are processed through secure payment gateways (Stripe or PayPal). Subscriptions automatically renew at the end of each billing cycle unless canceled prior to the renewal date.
If you reside within the European Union and purchase a subscription directly on our website (www.learn-drums.app), you have the legal right to withdraw from the contract within 14 calendar days from the initial purchase date without giving any reason, receiving a full refund.
To exercise your right of withdrawal, contact us at info@learn-drums.app within the 14-day period.
You may cancel your subscription at any time through your account profile settings on the website/app or by contacting support.
Upon cancellation, your subscription will remain active until the end of the current paid billing period. You will not receive a pro-rated refund for the remaining unused days of that billing period.
To use the app, you may need to physically connect your drum module or phone/tablet using third-party cables (e.g., USB Type-B, 3.5mm audio jacks, OTG adapters) or position your device near an acoustic drum kit.
We are not responsible for any physical damage, wear, electrical issues, or malfunction caused to your electronic drum modules, sound cards, tablets, smartphones, computers, cables, or adapters during or as a result of using the Service. You connect hardware devices at your own risk.
Drums are a physical instrument and involve loud sound pressure levels.
Playing drums (especially acoustic drums or electronic drums using headphones at high volume) can cause permanent hearing damage or tinnitus. You are strongly advised to keep headphone volumes at a safe level and wear certified hearing protection (earplugs/isolating headphones) when playing acoustic drums. We accept no liability for hearing impairments resulting from play sessions.
Playing drums involves repetitive movements. You should maintain correct posture and ergonomics. Stop playing immediately and consult a medical professional if you experience pain, numbness, fatigue, or symptoms of Repetitive Strain Injury (RSI) or tendinitis.
All software, code, drum notation, sound libraries, graphics, logos, game elements, and trademarks associated with Learn Drums Video Game are the exclusive intellectual property of Pietro Valente or its licensors. Unlawful reproduction or distribution of any application materials is strictly forbidden.
We reserve the right to suspend or terminate your account and access to the Service at our sole discretion, without prior notice, if you breach these Terms (including account sharing, commercial misuse, or unauthorized reverse engineering).
These Terms of Service and any disputes or claims arising out of or in connection with them shall be governed by and construed in accordance with the laws of Italy.
In the event of any legal dispute or claim that cannot be resolved amicably, the exclusive place of jurisdiction shall be the Court of Padua (Foro di Padova), Italy, except where mandatory local consumer protection laws prescribe otherwise for consumers residing within the European Union.
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on www.learn-drums.app and updating the "Last Updated" date. Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
